Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Card Value Scanner - TCG Vault mobile application (the "App") operated by Appcellent Yazilim Hizmetleri A.S. ("Appcellent," "we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

The App is a trading card game (TCG) collection management and price tracking tool. It allows you to scan trading cards, track their market value, manage collections, and access pricing data from third-party marketplaces.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must be at least 13 years of age to use the App. If you are under 18, you must have your parent's or guardian's permission to use the App.

2. Account and Data

When you use the App, a unique identifier is created to associate your collection data, preferences, and subscription status with your usage. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3. Subscriptions and In-App Purchases

3.1 Premium Subscription

The App offers premium subscription plans that unlock additional features, including but not limited to: AI-powered card scanning, interactive price history charts, multiple collection management, and direct marketplace links.

3.2 Subscription Plans

Subscription options and pricing are displayed within the App at the time of purchase. Plans may include weekly and annual billing cycles. Prices are subject to change, and any changes will be communicated before your next billing period.

3.3 Free Trial

We may offer free trial periods for certain subscription plans. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.

3.4 Billing and Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
  • You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Prices are in US dollars (USD) and may vary in other countries. Actual charges may be converted to your local currency depending on your country of residence.

3.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

3.6 Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple in accordance with their refund policies.

4. Card Data and Pricing

4.1 Pricing Information

Card pricing data displayed in the App is sourced from third-party marketplaces including TCGPlayer. Prices are provided for informational purposes only and may not reflect actual market conditions at any given time. We do not guarantee the accuracy, completeness, or timeliness of pricing data.

4.2 No Financial Advice

The App is not a financial advisory service. Card values, price trends, and collection valuations are provided for reference purposes only and should not be relied upon as the sole basis for buying, selling, or trading decisions.

4.3 Third-Party Marketplaces

The App may provide links to third-party marketplaces (such as TCGPlayer) for purchasing or selling cards. We are not responsible for the products, services, or practices of these third-party platforms. Your use of third-party marketplaces is subject to their own terms and conditions.

5. Card Scanning and AI Features

5.1 Scanning Accuracy

The card scanning feature uses optical character recognition (OCR) and AI-powered identification to recognize trading cards. While we strive for accuracy, we do not guarantee that every card will be identified correctly. Results may vary based on card condition, image quality, lighting, and other factors.

5.2 Camera Usage

The card scanning feature requires access to your device's camera. Images captured during scanning are processed on your device. Only extracted text data is transmitted to our servers for card identification. We do not store card images on our servers.

6. Intellectual Property

6.1 App Content

The App, including its design, features, code, and original content, is the property of Appcellent and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

6.2 Trading Card Content

Trading card names, images, and related content displayed in the App are the property of their respective owners and publishers (including but not limited to The Pokemon Company, Wizards of the Coast, Konami, Ravensburger, Bandai, and others). The App displays this content for identification and collection management purposes under fair use principles.

6.3 User Content

Any data you create within the App (such as collections and notes) remains your property. By using the App, you grant us a limited license to store and process this data solely for the purpose of providing the App's services.

7. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Use automated systems, bots, or scripts to access or interact with the App.
  • Attempt to gain unauthorized access to other users' data or accounts.
  • Use the App to infringe upon the intellectual property rights of others.
  • Resell, redistribute, or commercially exploit the App or its data without our written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF CARD DATA, PRICING INFORMATION, OR ANY OTHER CONTENT PROVIDED THROUGH THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPCELLENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Appcellent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appcellent regarding your use of the App and supersede any prior agreements.
